Terms of Use

These terms govern your use of https://omnitrace.co.za and the services offered by Omnitrace. By using the website or services you agree to them. They are subject to the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and the Consumer Protection Act 68 of 2008 where applicable.

1. Services

Omnitrace provides identity verification, biometric, tracing, AML/PEP screening, criminal record, bank account verification, credit and company search services. Services are quoted on request. Client accounts and searches are accessed through our secure partner platform, and its terms also apply.

2. Eligibility and accounts

Services are for businesses and professionals with a lawful, permissible purpose. You must give accurate registration information, keep your login details secret and are responsible for all activity under your account.

3. Permissible purpose and compliance

You may only request a search where you have a lawful reason and, where required, the data subject's consent, in line with POPIA, the National Credit Act, FICA and any other applicable law. You must comply with our Acceptable Use Policy. We may suspend accounts and report misuse.

4. Fees and payment

Fees are as quoted in writing. Unless agreed otherwise, services are prepaid and credits are non-refundable once used.

5. Accuracy of information

Results come from third-party sources such as Home Affairs, credit bureaus and screening databases. We pass them on as received and do not guarantee they are complete, current or error-free. You remain responsible for your own decisions.

6. Limitation of liability

To the extent the law allows, Omnitrace is not liable for indirect, consequential or special loss, or for loss caused by inaccurate source data, service interruptions or your misuse of results. Our total liability is limited to the fees you paid for the service concerned in the three months before the claim.

7. Indemnity

You indemnify Omnitrace against claims arising from your breach of these terms or of any law, including unlawful searches.

8. Intellectual property

The website content, design and branding belong to Omnitrace or its licensors and may not be copied without permission.

9. Website use

You may not interfere with the website, attempt unauthorised access, or use automated tools to scrape it.

10. Changes and termination

We may update these terms or suspend services on reasonable notice, or immediately in the case of misuse.

12. Governing law
